Out of the Mattress Participant Terms of Service

These terms apply when you pay for a one-on-one financial education session or a paid cohort program from Out of the Mattress (“OOTM”). In these terms, “we” and “us” mean Build Up, Inc., a 501(c)(3) nonprofit, acting through its fiscally sponsored project OOTM. By checking the agreement box on the payment page, you accept these terms.
1. What you’re signing up for
- One-on-one sessions: a private, one-hour financial education session with an OOTM instructor, held by video call, scheduled through our booking page after payment.
- Paid cohorts: a financial education program (group sessions plus a private session) on the dates listed on the program page when you enroll.
2. Education, not advice
Our sessions are financial education, not individualized investment, legal, or tax advice. We don’t recommend or sell any financial products, we don’t manage money, and we don’t form an advisor-client relationship. You make your own financial decisions.
3. What you pay, and where it goes
- One-on-one sessions are pay-what-you-can with a $100 minimum. The fair market value of a session is $100. Anything you choose to pay above $100 is a charitable contribution to Build Up, Inc., deductible to the extent allowed by law. For any payment over $75, we’ll send you a written receipt stating the $100 value of the session and the donation portion, as the IRS requires.
- Paid cohorts cost what the program page lists when you enroll. The listed price is the fair market value of the program; any amount you choose to pay above the list price is a charitable contribution and deductible to the extent allowed by law. For any payment over the listed price, we’ll send you a written receipt stating the fair market value (the listed price) and the value of your donation.
- Stripe™ processes payments on behalf of Build Up, Inc.
4. Rescheduling, cancellation, and refunds
If you are unable to attend your scheduled session, you may be eligible for a partial or full refund, based on the amount of advance notice you provide to us.
- One-on-one sessions: if you notify us at least 24 hours prior to your session, you have the option to reschedule or to cancel and receive a full refund, whichever you prefer. If you do not provide at least 24 hours’ notice, or if you don’t show, you will not receive a refund. If you believe there was a compelling reason why you needed to cancel or why you didn’t show, please let us know. We will review your reason and, at our sole discretion, we may be able to reschedule or offer a partial refund.
- Paid cohorts: you have the option to receive a full refund any time up to 24 hours before the first session, and a prorated refund if you withdraw before the second session. After the second session, refunds are no longer available, but you can apply the fee to a future cohort whose sessions begin within 365 days of the original cohort you enrolled in.
- If we cancel and can’t offer you a time or cohort that fits your schedule, we will refund your fee. That refund is the full remedy.
5. Confidentiality
What you share with us in a private session stays private; we won’t share it outside OOTM except as required by law. In cohort sessions we ask all participants to keep private what’s shared in the room, however, we can’t control what other participants do, so share at your own comfort level.
6. Materials
We have dedicated time and expertise in creating the materials for our programs. The session and program materials are our intellectual property and are protected by copyright and trademark laws. You may keep the materials we share with you and use them for personal use only. You may not share or republish our materials without our written permission.
7. Liability
Our total responsibility to you under these terms is limited to what you paid. Neither of us is responsible for indirect or consequential damages. This limit doesn’t apply to gross negligence or willful misconduct.
8. The legal basics
These terms plus your payment confirmation are the whole agreement between us. Changes to these terms apply from the “last updated” date above and don’t affect sessions or cohorts already paid for. New York law governs, and disputes go to the state or federal courts in New York. If any part of these terms is unenforceable, the rest of the terms still apply.
